Brandon Rinehart Wins Against California

What is the legal intent to not publish the ruling? I understand the obvious for this case, however the reason for all unpublished rulings is what?

My opinion is that.........

The proceedings at San Bernardino court with Judge Ochoa,  would be significantly altered prematurely.  In other words Plumas County court needs to make judgement utilizing the federal preemption defense of Brandon.  Plumas did not hear the preemption defense and found Brandon guilty.  

 

Once the ducks get correctly aligned, Brandon might be found innocent back at the original Plumas court.

 

Then the San Bernardino court can correctly follow the Plumas revised and new decision based upon federal law carries the power over California ban on issuing dredging permits as being UNCONSTITUTIONAL.

 

Then we can expect restrictions other than CA to be changed back to what Congress intended.

We need to make some effort towards getting the high court decision published.  Public input is required.  It's some legal deal which on the surface seems almost silly, but it's VERY important.

 

Please do the right thing and send in your request for publication.  These blank forms will help you to understand.
